Terms and Conditions

If you want to buy from us or use our web site you can only do so on these terms and conditions, and by purchasing on the web site or ordering via email or phone you are agreeing to be bound by them. We may change these from time to time by updating this page.

Customer Commitment
Quality - We are committed to the quality of our Dressings. If you buy any of our Dressings and you don't like a bottle, we will offer you another bottle or credit you the purchase price of that bottle if you provide notice within 7 Days of date of purchase. If you have bought a whole case of one particular Dressing which you don't like, and provided you have only opened one bottle from the case, then we will replace the whole case with another product or refund you the purchase price, as soon as we have collected the rest of the Dressings from you.

Delivery - Delivery charges vary depending on the delivery area and how many cases you order. Deliveries are only available within New Zealand. Delivery times vary between region but we will strive to have your goods delivered to you within 5 working days of your payment clearing. We will contact you if for any reason we cannot deliver your goods in 5 working days. At that point you may decide to cancel your order for a full refund or wait for your goods to be delivered. If you are not home when we deliver we will leave the Dressing in what we think is a safe place outside your house. If we can't find a safe place we will take the Dressing back and deliver it another time. You can provide us with some instructions on delivery when you checkout from our website or when you email us your order. We can also deliver to your workplace if that is easier.

Stolen Dressings and Breakages
Stolen Dressings - If we leave your Dressing outside your house and the Dressing gets stolen, we will ship you replacement Dressing free of charge, providing you notify us within 7 days.

Breakages - In the event that any of the bottles in your case are damaged, please let us know within 7 days and we will ship you replacement bottles or issue you with a full refund.

Availability -  If you order Dressing from us and we run out of stock, we may change some of the bottles without asking you. We will always change the bottles for equivalent or better quality bottles. If you ever have cause to disagree with our choice of replacements, we will take back the bottles and give you a credit, no questions asked. If we don't feel we can offer a suitable replacement we will ship your order without the products we can't supply.

Customer satisfaction
- If you are dissatisfied with our performance in any way, please contact our customer services department immediately at [email protected]. At Fussyfoodie.co.nz, we aim to deal with all enquiries fairly, confidentially and quickly. We try to resolve most issues immediately, but where this is not possible, we will keep you informed about progress until a satisfactory resolution has been achieved.

Prices and payment
All prices are quoted in New Zealand Dollars. Delivery in addition to the product price. 

We accept payment by Visa, Mastercard, and other major accepted credit cards. All payments will be processed in NZD.
We will not ship goods until your payment has cleared.
We reserve the right to terminate any special offer at any time, without notice.

Returns
If some or all of the bottles of Dressing in a case are broken or spoiled when they are delivered you should notify us as soon as possible. You may choose either to return the whole case or just the affected bottles for a refund.

You must notify us of all Dressings which are due to be returned for any of the reasons stated in this clause within 7 days from delivery of the Dressing, otherwise you cannot rely on Clause 4a above.
All refunds and reimbursements under Clause 4a will be paid within 30 days of you notifying us of your wish to return Dressing under that clause, provided the Dressing has been collected by our carrier.
Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty goods.
Purchases may be cancelled free of charge before they are shipped away. In this instance, refunds will be processed within 30 days of you notifying us.

Warranties

We warrant that the Dressings will be of satisfactory quality and fit for their general purpose.

Limitation of liability
You agree that Fussyfoodie.co.nz will be not be liable for any loss or damage caused by us or our employees or agents in circumstances where:

  1. loss or damage was not foreseeable to both parties when the contract was formed;
  2. loss or damage was not caused by any breach on the part of the supplier;
  3. loss or damage relates to business and/or non-consumers.
  4. We will not be liable for loss or damage caused by the customer handling the Dressing. In particular we will not be liable for spillages or breakages.
  5. A case of Dressing is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.
Data Protection

By providing your details to Fussyfoodie.co.nz on our web site or via email, you consent to us maintaining, recording, holding and using the information you give us at the time of ordering to process your orders, to improve our service to you and inform you of promotions.

Fussyfoodie.co.nz Privacy Promise.
We take your privacy very seriously and will not pass your details to any third party without your permission, other than where we have to do so to get your Dressing to you, e.g. our delivery company.
If you opt-out from hearing from Fussyfoodie.co.nz you will not hear from us unless it is regarding a specific order made by you or unless we make an important update to our Terms and Conditions.

General
We shall not be liable for any delay in delivering your Dressing if that delay or failure is caused by circumstances beyond our control such as, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or Act of God, failure of ISP or telecommunications provider in connection with the performance of this Agreement.
Fussyfoodie.co.nz may change or add to these terms and conditions for security, legal or regulatory reasons.
Relevant Relevant New Zealand law will apply to these terms and conditions and the relevant courts of New Zealand will have exclusive jurisdiction.
